I think surprise is supposed to reflect how taken aback you are. Can you find your weapon, can you come to your senses fast enough and mount a counter attack. The back stab (hit or not) would be the moment the opponent is aware of you (just as when you kick in the door of a couple unsuspecting orcs)

I don't disagree; however, for purposes of back-stabbing, I would say that the ability is negated at that point.
